1. Introduction and Acceptance

cr8rs ("we", "us", "our", or "the Platform") is a creator monetization, distribution, and gratification platform operated by Meta Stream Incorporated Pvt. Ltd. (Registered Company Number: 279147/078/079, Nepal). cr8rs connects content creators of all kinds - streamers, video creators, podcasters, artists, and others with their audiences through tools and features built around monetization, distribution and gratification. Current monetization features include one-time tips with additional monetization options being developed. These Terms & Conditions ("T&C") govern the relationship between cr8rs and all users of the Platform. Users are classified as:

  • Creators - content creators of any kind who register a cr8rs account to monetize their audience and receive support from their audience through cr8rs's monetization tools.
  • Contributors - users who support Creators through tips or other available monetization features on cr8rs.
  • Visitors - anyone browsing the cr8rs site who has not yet registered or tipped.

Acceptance is as follows:

  • Visitors accept these T&C by the mere act of browsing or accessing cr8rs.
  • Contributors accept these T&C by checking the acceptance checkbox presented at the point of transaction prior to any monetization action (e.g., sending a tip).
  • Creators accept these T&C at the time of account creation by clicking on continue.

cr8rs also displays a footer notice on all pages and profile pages and account menu in dashboard stating: "By interacting on this page, you are agreeing to our Terms & Conditions and Cookie Policy." This notice serves as a persistent reminder of acceptance.

cr8rs is accessible to content creators in Nepal and expats living abroad who are creating content and using cr8rs for monetization. However, cr8rs currently supports payouts only to verified Nepalese bank accounts or Khalti digital wallets. Creators residing outside Nepal must hold a valid Nepalese bank account or Khalti wallet to receive withdrawals. cr8rs does not currently support payouts to foreign bank accounts or international wallets. International Appreciation Tips are supported via Visa/Mastercard card payments as detailed in Chapter 2. cr8rs is not a Bank or Financial Institution (BFI), Non-Bank Financial Institution (NBFI) or a regulated payment operator. cr8rs maintains records of Creator balances and Appreciation Tip transactions in the capacity of a Merchant of Record - tracking amounts received and owed to each Creator and facilitating payouts accordingly.

2. Definitions

The following terms are used throughout this document:

"cr8rs" / "the Platform": The cr8rs platform (previously StreamersAlert), a service of Meta Stream Incorporated Pvt. Ltd., accessible at cr8rs.app, cr8rs.me, cr8.rs and all related subdomains, applications, widgets and APIs. All references herein to 'the Platform', 'we', 'us', or 'our' refer to cr8rs and/or Meta Stream Incorporated Pvt. Ltd.

"Appreciation Tip": A monetary amount voluntarily sent by a Contributor to a Creator through cr8rs as a form of appreciation for their content. Appreciation Tips are not donations, gifts, business payments or charitable contributions. They are non-business, non-commercial appreciation transactions. cr8rs does not guarantee any content delivery or obligation in exchange for an Appreciation Tip. Tips are one of multiple monetization features available on cr8rs.

"Creator": Any content creator - including but not limited to streamers, video creators, podcasters, artists, and writers - who has registered a cr8rs account to monetize their content and receive support from their audience through cr8rs's monetization tools. A Creator may also act as a Contributor to other Creators.

"Contributor": A user who interacts with and supports a Creator through cr8rs's monetization features (e.g., by sending a tip). Account registration is optional for Contributors for tip transactions; a Contributor may transact as a guest by providing necessary details at the time of the transaction, or may register a cr8rs account to track their activity history and access tools to engage with creators on the platform.

"Visitor": Any person accessing or browsing the cr8rs Platform who has not registered an account or interacted via any monetization feature.

"Services": All products, tools, widgets and features provided by cr8rs to facilitate creator monetization, distribution and gratification. This includes but is not limited to - tip processing, on-stream and on-platform alert widgets, creator profile pages, monetization dashboards, analytics tools, audience engagement features and any related services offered now or in the future.

"Platform Fees": The service fees deducted by cr8rs from each transaction before crediting the net amount to a Creator's balance. See Chapter 2 for applicable rates.

"KYC": Know Your Customer - cr8rs's internal identity and financial verification process conducted as part of its own due diligence before enabling Creator withdrawals. While cr8rs is not a regulated payment operator, KYC is carried out to promote platform integrity and assist with AML/CFT compliance obligations where applicable.

"Merchant of Record": cr8rs maintains records of all Creator balances and monetization transactions in the capacity of a Merchant of Record. cr8rs tracks amounts received and owed to each Creator and issues payouts accordingly. In some payment flows, Meta Stream Incorporated Pvt. Ltd. (or its authorized payment gateway partner) may appear on the Contributor's statement as the transaction merchant.

"Guardian Account": A cr8rs account for a minor Creator (aged 13–17) that is registered, owned and operated by the minor's parent or legal guardian on behalf of the minor.

3. Eligibility and Age Policy

3.1. General Eligibility

To use cr8rs you must:

  • Be legally capable of entering a binding agreement under the laws of your country of residence.
  • Be at least 13 years of age, or the age of majority in your country of residence, whichever is higher - unless you qualify under the Minor Creator provision below.
  • Not be prohibited from using the Services under any applicable law.

3.2. Minor Creators - Guardian Account Provision

cr8rs recognizes that many content creators across all content formats - streaming, video, podcasting and others are under 18 years of age. Some of the platforms Creators use (YouTube, Twitch, TikTok, Instagram, Facebook etc.) permit minors to create and publish content with parental/guardian consent or presence. cr8rs extends a corresponding provision for minor Creators aged 13 and above, subject to all of the following conditions:

  • Guardian Account Required: A minor Creator (aged 13–17) may not register a cr8rs account in their own name. Instead, the minor's parent or legal guardian ("Guardian") must register the cr8rs account. The account is owned by and legally belongs to the Guardian.
  • Guardian Responsibility: The Guardian accepts these T&C on behalf of the minor and is fully and personally responsible for the minor's use of the Platform, compliance with these T&C, and all activity under the account.
  • KYC and Payout in Guardian's Name: All KYC verification, payout account linking (Khalti or bank) and financial transactions must be in the Guardian's legal name. The Guardian's verified Khalti or bank account is used for all payouts. Payouts cannot be made to an account in the minor's name.
  • External Platform Compliance: The Guardian warrants that the minor's content creation activity on their primary content platform(s) complies with the age and content policies of those platforms.
  • Guardian Consent Documentation: cr8rs may request written evidence of guardianship or parental consent at any time. Failure to provide such evidence may result in account suspension.
  • Age of 18: When the minor Creator turns 18, the account must be transferred to the now-adult Creator, who must complete their own KYC verification and link their own payout accounts. cr8rs will provide a transfer procedure for this.

3.3. Contributors Who Are Minors

cr8rs does not knowingly accept Appreciation Tips from users who are minors without parental/guardian consent. If a minor wishes to send an Appreciation Tip:

  • The transaction must be processed using a payment account that belongs to and is operated by a parent or legal guardian.
  • The parent or guardian, by allowing use of their payment account, consents to the transaction and accepts responsibility for it.
  • cr8rs cannot independently verify the age of a Contributor at the time of tipping. If cr8rs discovers that a minor is using the Platform without appropriate parental consent, that user may be banned and any pending transactions reviewed.
  • Parents and guardians are advised to use the parental controls or multi factor verification features provided by their card issuer, bank or digital wallet to restrict access to payment accounts.

4. User Obligations and Conduct

4.1. Contributor Obligations

When supporting a creator, Contributors agree to:

  • Payment Processing: Choose one of the payment methods provided (domestic digital wallet, domestic card or Visa/Mastercard international card). All Appreciation Tips are processed in Nepalese Rupees (NPR). For international card payments, your card provider converts your local currency to NPR; any conversion or foreign exchange fees are borne by you (the Contributor).
  • Tip Limits: Adhere to the minimum and maximum tip amounts set by cr8rs and our payment processors. Domestic tips: minimum NPR 10, maximum NPR 25,000 per transaction. International tips (Visa/Mastercard): minimum NPR 100, maximum NPR 35,000 per transaction. Creators may set more restrictive limits on their own profiles. These limits may change in accordance with regulatory requirements.
  • Immediate Charge: The chosen tip amount is charged immediately to your payment method at the time of transaction.
  • No Contact Details to Creators: Only your display name and message (if any) are shown to the Creator. Your payment details are never disclosed to the Creator. cr8rs does not store your card number - cr8rs only retains a transaction reference and, where applicable, a payment wallet identifier provided by the payment gateway.
  • Respectful Content: Any message included with a tip must comply with our Community Guidelines (Chapter 3).
  • Legitimate Funds: You confirm that the funds used come from legitimate, legal sources. You agree not to use cr8rs for money laundering, fraud or any illicit financial activity.
  • Third-Party Terms: You agree to the terms of any third-party payment gateway used. cr8rs is not a bank or financial institution; it facilitates payments via integrated payment services.

4.2. Creator Obligations

When registering and using a cr8rs Creator account, you agree to:

  • Account Registration: Register via the provided login options. You are responsible for providing accurate information, including your legal name and contact details, which must match your payout account details and KYC details.
  • Account Security: Maintain the confidentiality of your cr8rs login credentials. You are responsible for all activities under your account. If you suspect unauthorized access, notify cr8rs immediately at support@cr8rs.app.
  • One Account Rule: You may only have one cr8rs Creator account. Multiple accounts to bypass suspensions or circumvent limits are prohibited. Do not impersonate others or use a false identity.
  • Payout Account Verification: As part of cr8rs's internal due diligence process, you must link a verified payout account before withdrawing. This is cr8rs's own internal requirement to ensure payouts go to the correct person and to support AML/CFT best practices. See Chapter 2 for payout verification details.
  • Payout Account Changes: Once a payout account is verified and linked, any change requires administrative approval and re-verification.
  • Taxes: You are responsible for reporting and paying any income tax or other taxes on amounts you earn through cr8rs's monetization features. cr8rs deducts VAT on its service fees but does not withhold income tax on your behalf. cr8rs can provide annual earnings statements on request. A separate optional tax assistance service is available - contact info@cr8rs.app for details.
  • Closing an Account: You may close your cr8rs account at any time by contacting support. Upon closure, any remaining cleared balance (above the minimum withdrawal threshold and not subject to dispute or investigation) will be paid out to your verified payout account.

4.3. cr8rs Role

cr8rs is an intermediary facilitating creator monetization. cr8rs is not a publisher of your content and does not control your activity on external platforms. However, your use of cr8rs must comply with these T&C and our Community Guidelines (Chapter 3).


5. Payments, Refunds, and Withdrawals

5.1. For Contributors

cr8rs does not charge Contributors any platform fee. You pay only the amount you choose to send, plus any currency conversion or foreign exchange fees charged by your card issuer or bank for international transactions.

5.2. Refunds on Domestic Tips

Domestic Tips (processed via domestic Nepali payment methods such as Khalti, domestic cards, or other domestic payment gateways) are generally non-refundable once sent. Attempting a transaction to test the system, check functionality or for any purpose other than genuine support of a Creator will not qualify for a refund.

Exceptions on Domestic Tip Refunds: A domestic tip may be refunded in the following circumstances only:

  • Verified unauthorised account access or fraudulent use of a payment account - supported by documentation.
  • Technical error by cr8rs resulting in a duplicate charge or incorrect amount, where a Creator’s account is not credited.
  • A valid order from a law enforcement authority, regulatory body or court of competent jurisdiction (e.g., Nepal Rastra Bank's Financial Information Unit in cases involving AML/CFT investigations).
  • Any other circumstance where cr8rs is legally required to refund under applicable Nepalese law.


5.3. Refunds on International Tips (Visa/Mastercard) & Creator-Side Holding Period

For tips received via Visa or Mastercard international card payments, cr8rs applies a holding period on the Creator's side before releasing funds to the Creator's balance:

  • Holding Period: Once an international Appreciation Tip is successfully processed, the net tip amount is held by cr8rs for 7 days before being credited to the Creator's balance. This holding period applies on the Creator's side and is recommended by our payment gateway as a standard risk management protocol to protect both cr8rs and the Creator from future refunds or chargebacks on that transaction.
  • Why This Exists: cr8rs does not store contributor card numbers. The payment gateway processes the card transaction and notifies cr8rs of the outcome. The 7-day hold is a safeguard that gives time for any disputes, chargebacks or fraud flags to surface before funds are released to the Creator. This protects the Creator from having to return funds that were later reversed.
  • Refund Window: During this 7-day holding period, a Contributor may request a refund by contacting support@cr8rs.app. Valid grounds include: fraud or unauthorised use of a payment method, a verified technical error that resulted in an incorrect charge or other documented dissatisfaction where cr8rs determines a refund is fair and warranted. This refund window exists to protect Contributors from genuine errors while safeguarding Creators from delayed uncertainty. Refund requests will not be accepted after the 7-day period has elapsed.
  • Service Charges: Currency conversion fees, international transaction fees or card-processing fees charged by the card network, issuer or payment gateway are non-refundable regardless of whether the tip is refunded, as these are levied by third parties outside cr8rs's control.
  • Chargeback Process: cr8rs cooperates fully with chargeback processes. If a chargeback is upheld, the funds will be recovered from the Creator's account as described in §1.5.5.

5.4. Refund Process - How to Request

The correct process for requesting a refund is:

  • Step 1 - Contact the Creator directly: For dissatisfaction with content or a Creator-related issue, the first step is to contact the Creator directly. cr8rs does not adjudicate content disputes between Contributors and Creators.
  • Step 2 - Contact cr8rs Support: If your refund request falls within the eligible exceptions listed in §1.5.2 or §1.5.3, contact cr8rs support at support@cr8rs.app with your transaction ID, date, amount and a description of the issue.
  • Step 3 - cr8rs Review: cr8rs will review the request and also contact the creator on the refund issue. Note that cr8rs does not currently provide a self-service refund tool for Creators; all eligible refunds are processed by the cr8rs support team on the Creator's behalf.

5.5. Refund Impact on Creator Balance

If a refund or chargeback is approved and the Creator's account has a sufficient available balance, the refunded amount will be deducted from the Creator's balance immediately. If the Creator's balance is insufficient to cover the refunded amount:

  • 30% of each net Appreciation Tip received by the Creator will be withheld and applied to the outstanding refund amount until the full amount is recovered. The percentage of withheld may vary upon creator in accordance with the recoverable balance and creators ability to recover.
  • The deduction continues with each subsequent tip received until the amount is fully cleared.
  • cr8rs will notify the Creator of any refund obligation and the recovery schedule.
  • Platform service fees charged on the original tip may or may not be refunded depending on the payment gateway involved. cr8rs will communicate the applicable fee refund status on a case-by-case basis.

5.6. Special Cases - Law Enforcement

In the event of a police or regulatory investigation related to money laundering, financing of terrorism, fraud or other criminal activities, cr8rs is legally obligated to comply with official law enforcement orders. Refunds in such cases are processed upon receipt of valid, verifiable police orders or judicial instructions, and only after thorough verification of legal documentation.


5.7. For Creators - Earnings and Withdrawals

  • Earnings: When a Contributor sends you an Appreciation Tip, cr8rs deducts the applicable Platform Fee (see Chapter 2) and credits the net amount to your cr8rs account balance. Domestic tips are credited immediately after payment confirmation. International tips are marked pending for 7 days, then credited after the hold period clears.
  • Withdrawal - On Demand: Withdrawals are processed on demand. You may initiate a withdrawal at any time from your cr8rs dashboard, subject to having met payout account verification requirements and the minimum withdrawal thresholds.
  • Khalti Payout: Minimum withdrawal NPR 100. Khalti supports a maximum single payout of NPR 25,000. Payouts to Khalti are typically processed within 3 business days and are free of charge.
  • Bank Transfer Payout: Minimum withdrawal NPR 100. Bank transfers support a maximum single payout of NPR 50,000. Bank transfers are processed within 5 business days. cr8rs does not charge a withdrawal fee for bank transfers; however, your bank may charge a minimal processing or credit fee on their end, which will appear as a separate transaction on your bank statement after the funds are credited.
  • Withdrawal Delays: In case of bank holidays, technical issues, payment gateway downtime or unforeseen regulatory directives, cr8rs will process the withdrawal on the next available business day.
  • VAT Billing: VAT invoices for cr8rs's service fees are generated and issued in billing batches on a periodic cycle. You will receive your VAT statement accordingly. Or, you may email at finance@cr8rs.app to request for your VAT invoice.

5.8. Stream Alert Non-Delivery

cr8rs's stream alert system depends on real-time confirmation from payment gateways. While cr8rs works to ensure every confirmed tip triggers an alert notification, there are scenarios where a confirmation is delayed or alert delivery fails. In case of:

  • Undelivered Alert : If a tip was successfully processed but the alert notification was not delivered (e.g., due to a delayed payment confirmation or a temporary system issue), the Creator can retrigger the missed alert from the Live Action Widget on their dashboard. This is the preferred resolution.

5.9. No Reversals Outside Refund Policy

Except for the refund mechanism described above and chargeback situations, cr8rs will not claw back or reverse Appreciation Tips that have been credited to a Creator's balance. If you have a concern about a tip (e.g., it was accompanied by a malicious message), you may contact support, but financial reversal is generally not possible outside the stated refund policy.

6. Platform Rights and Liabilities

6.1. cr8rs's Rights

cr8rs reserves the right to:

  • Modify or discontinue any aspect of the Services at any time, with notice where feasible.
  • Suspend access to the Platform for maintenance or upgrades.
  • Update these Terms or any policies at any time. Updated terms will be posted on the Terms & Conditions page at cr8rs.app/policies and communicated via site notice or email where applicable. Continued use of the Platform after the effective date of an update constitutes acceptance of the revised terms. cr8rs will not suspend or close a Creator's account solely because the Creator has not explicitly acknowledged updated terms - the act of continuing to use the Platform is itself deemed acceptance.
  • Refuse service, terminate accounts or cancel transactions at cr8rs's discretion if cr8rs suspects violations of these T&C or malicious activity.

6.2. Limitation of Liability

cr8rs provides the Services on an "as is" basis. To the maximum extent permitted by applicable law, cr8rs is not liable for:

  • Any indirect or consequential damages, loss of profits arising from use of the Services.
  • The actions or omissions of other users (Creators or Contributors). If a Creator does not respond to tips or a Contributor sends abusive content, cr8rs is not responsible for those user behaviors (though cr8rs may take action against the offending account).
  • Any downtime or technical issues of the Platform or payment gateways that temporarily prevent tipping or withdrawals. cr8rs will work to resolve issues as quickly as possible.
  • Payment processing decisions made by third-party payment gateways, card networks, or banks.

Liability Cap: In the event of any loss, error or failure attributable to cr8rs, cr8rs's maximum liability to any Creator shall be limited to the Creator's verified available account balance held by cr8rs at the time of the event giving rise to liability. This reflects cr8rs's core obligation - to hold and pay out what belongs to the Creator. cr8rs maintains internal backup records of Creator balances to support accurate assessment of any such claim. This cap does not apply in cases of cr8rs's own gross negligence or willful misconduct, which are subject to uncapped liability under Nepalese law.

6.3. Indemnification

Users (Creators and Contributors) agree to indemnify and hold harmless cr8rs and Meta Stream Incorporated Pvt. Ltd. (including its directors, officers and employees) from any claims, losses, liabilities or expenses (including legal fees) arising from the user's own breach of these T&C, illegal activity or infringement of any third party's rights.

Reciprocal: cr8rs agrees to indemnify and hold harmless Creators from third-party claims arising directly from cr8rs's own gross negligence, willful misconduct or breach of these T&C.

6.4. Content and Conduct

cr8rs is a monetization intermediary and does not control, moderate or have editorial responsibility for the content Creators produce on their external platforms. cr8rs is not liable for any content published on external platforms or any third-party content. The Creator is solely responsible for their content and compliance with the laws and community standards of the platforms they use.

cr8rs does not guarantee the quality, frequency, duration or availability of a Creator's content. Any support sent through cr8rs is done at the Contributor's discretion. It is not a purchase of goods or services and carries no obligation on the Creator to produce specific content.

Prohibited Uses: You may not use cr8rs for activities that are deceptive, fraudulent, illegal or harmful, including but not limited to: money laundering, financing of terrorism, solicitation of minors, harassment, hate speech, or any activity that violates the Community Guidelines (Chapter 3) or applicable law. If such misuse is detected, cr8rs may suspend or terminate the offending account(s) immediately and report the activity to law enforcement or regulatory authorities (including Nepal Rastra Bank's Financial Information Unit in cases of financial crimes) without pre-informing the offender.

6.5. Account Suspension and Termination

Immediate Suspension: cr8rs may suspend or terminate a Creator's or Contributor’s account without prior notice for fraud, illegal activity or activity that poses an immediate risk to users or the Platform.

Notice and Cure: For violations that are not fraudulent or illegal, cr8rs will provide 7 days' written notice (via registered email) and an opportunity to remedy the violation before taking suspension or termination action.

On Termination:

  • The creator will be notified via their registered email.
  • Any remaining balance may be frozen pending investigation. If the violation caused harm or losses to cr8rs or Contributors, cr8rs may withhold all or part of the Creator's balance as damages. Otherwise, any cleared remaining balance may be refunded to Contributors (or donated to charity at cr8rs's discretion) rather than paid to the banned Creator.
  • The Creator may contact cr8rs to appeal or to request payout of any permissible remaining funds. If cr8rs decides to return funds, the Creator must provide necessary information within 2 months of notification. Failure to do so may result in forfeiture of those funds.

Contributors who violate the Community Guidelines or engage in fraudulent payment activity may be banned from further use of the Platform. Severe violations will be reported to the relevant authorities.

7. Intellectual Property

7.1. cr8rs Platform IP

cr8rs's brand assets (name, logos, slogans, designs, platform code, templates and related materials) are the intellectual property of Meta Stream Incorporated Pvt. Ltd. Unauthorized use is prohibited. See Chapter 5 for brand asset usage guidelines.


7.2. User Content - Ownership and Licence

Ownership: Content that users create and upload to cr8rs - including Creator-designed alert overlays, custom widget designs, uploaded GIFs, stickers, sounds, animations, and other creative assets ("User Content") - remains the intellectual property of the user who created it. cr8rs does not claim ownership over User Content.

License to cr8rs: By submitting or uploading User Content to cr8rs, you grant cr8rs a non-exclusive, royalty-free, worldwide license to store, display, transmit, process, and reproduce that User Content solely for the purpose of providing the Services (e.g., displaying your alert overlay, rendering widget content, or processing a tip notification). This licence ends when you delete the content from cr8rs or close your account, except where retention is required for legal or operational reasons.

Tip Messages: Tip messages submitted by Contributors are User Content. The Contributor retains ownership of the message. cr8rs is licensed to store, transmit and display the message to the relevant Creator as part of the Services.

cr8rs Templates: Alert templates, widget templates, and other pre-built design assets provided by cr8rs are the property of cr8rs. You may use them as intended within the Platform but may not copy, reproduce or distribute them outside the Platform.

Storage and Re-access: cr8rs stores User Content (overlays, custom assets) so that Creators can re-access, re-configure and re-trigger them across sessions.

cr8rs Not Liable for Third-Party Content: Creators are solely responsible for ensuring that any content they upload to cr8rs (including sounds, images, GIFs) does not infringe on third-party intellectual property rights. cr8rs is not liable for User Content that infringes third-party IP and cr8rs may remove infringing content upon receiving a valid notice.

Marketing Use: cr8rs may request permission from Creators to use examples of their cr8rs usage (e.g., an alert widget firing, a tip notification on screen, or a profile page screenshot) for cr8rs's own marketing and promotional purposes. Such use will only occur with the Creator's explicit consent, which may be given or withdrawn at any time. No Creator content on external platforms will be used without explicit consent.

External Platform Content: cr8rs does not claim any rights over a Creator's content published on external platforms (YouTube, Twitch, Facebook, TikTok, Instagram, etc.). That content is governed by the Creator's own agreements with those platforms.

8. Duration and Termination of Agreement

These T&C apply as long as you use cr8rs:

  • Visitors: from the moment you access the site until you leave.
  • Contributors: for each tipping transaction and overall use of the Platform while sending tips or engaging with the creators.
  • Creators: from account creation until the account is closed, terminated or suspended.

You may terminate your agreement with cr8rs at any time by ceasing use (for Contributors and Visitors) or closing your account (for Creators). cr8rs may terminate or suspend the agreement as described in §1.6.5, or as required by law or regulatory directive.

9. Force Majeure

Neither cr8rs nor any user shall be liable for any failure or delay in the performance of their obligations under these T&C to the extent caused by circumstances genuinely beyond their reasonable control, including without limitation: acts of God, natural disasters, earthquakes, floods, fire, epidemic, government orders, regulatory directives, Nepal Rastra Bank directives, internet or telecommunications outages, power failures, banking system failures, third-party payment gateway failures or civil unrest.

cr8rs will notify affected users of any such event as soon as reasonably practicable and will resume normal service as quickly as possible. During a force majeure event, cr8rs's withdrawal processing and payment obligations are suspended for the duration of the event. This provision does not affect cr8rs's obligations to hold and protect user funds.


10. Governing Law, Dispute Resolution, and Jurisdiction

10.1. Governing Law

These T&C and any disputes arising from them or the use of cr8rs are governed by the laws of Nepal. Meta Stream Incorporated Pvt. Ltd. is a Nepal-registered entity, and all Services are provided under Nepalese jurisdiction.

10.2. Dispute Resolution - Step Process

Before initiating formal proceedings, the parties agree to follow this step-by-step dispute resolution process:

  • Step 1 - Contributor/Creator Direct Resolution: For disputes between a Contributor and a Creator (e.g., regarding the content or use of a tip), the parties should first attempt to resolve the dispute directly.
  • Step 2 - cr8rs Facilitation: If direct resolution fails, either party may contact cr8rs support at support@cr8rs.app. cr8rs will review the matter and attempt to facilitate a fair resolution. cr8rs aims to respond to dispute submissions within 10 business days.
  • Step 3 - Communication / Informal Resolution: For disputes between a user and cr8rs, the user must first notify cr8rs in writing (at legal@cr8rs.app) describing the nature of the dispute. cr8rs and the user will attempt to resolve the matter informally within 30 days of the notification.
  • Step 4 - Arbitration: If the dispute is not resolved informally within 30 days, either party may initiate arbitration under the Nepal Arbitration Act 2055 (1999). For disputes involving amounts under NPR 1,00,000, cr8rs and the user agree to attempt mediation through a mutually agreed mediator before proceeding to arbitration.
  • Step 5 - Courts: If arbitration is unsuccessful or unavailable, disputes will be subject to the exclusive jurisdiction of the courts of Nepal.

10.3. Severability and Waiver

If any provision of these T&C is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full effect. cr8rs's failure to enforce any provision is not a waiver of its right to do so later.
